Terms and Conditions
Please read the following terms and conditions carefully before submitting your application. By submitting this application you acknowledge that you have read, understand and accept the terms and conditions set forth below.
You are requesting a privately-funded refinance loan that must be repaid in full. The proceeds of this loan must be used to refinance or consolidate loans that were used solely for permitted educational purposes of loans obtained through a Title IV degree granting institution.
When the Loan Processor receives this application, it is not agreeing to lend you money and there will not be such an agreement until the time that the loan is actually disbursed to your existing lender(s). The Lender has the right to accept or reject your application for credit.
By submitting this application, you certify that the information on this application is true and correct to the best of your knowledge. In addition, by submitting this application, you authorize the Loan Processor to verify the accuracy and authenticity of all information supplied by you, both internally and with the assistance of non-affiliated third parties. Specifically, you authorize the Loan Processor to contact your existing lender(s), your school(s), employer(s), and other organizations to determine eligibility and payoff amounts for the loans you have selected for refinancing and/or consolidation, and to confirm your graduation and employment status. You also authorize your existing lender(s) to provide payoff and other information about the loans you have selected for refinancing and/or consolidation to the Loan Processor and the Lender. In all cases, the Loan Processor may disclose the fact that you are applying for credit from the Lender. You also authorize the Loan Processor to release the information in this request and your credit eligibility information to the Lender, the loan servicer, and Splash Financial, Inc. as a party assisting you with the loan application.
Bank of Lake Mills will be the initial lender of record for your student loan. The borrower will receive notification when the loan is sold.
You understand and agree that the Lender and Lender’s agents (including the Loan Processor) may obtain a consumer credit report in connection with your loan application and in connection with any updates, renewals or extensions of any credit as a result of this loan application. If you ask, you will be informed whether or not such a report was obtained and, if so, the name and address of the agency that furnished the report. You also understand and agree that Lender or Lender’s agents may obtain a consumer credit report in connection with the review or collection of any loan made to you as a result of your loan application or for other legitimate purposes related to such loan.
If the loan payoff amount(s) paid to your existing lender(s) is more than the amount(s) needed to pay off the balances of the loans you have selected for refinancing and/or consolidation, you authorize your existing lender(s) to refund the excess to the Loan Processor or Lender to be applied towards your loan from the Lender. If the amount(s) paid to your existing lender(s) is less than the amount(s) needed to pay off the balances of the loans selected for refinancing and/or consolidation, you are responsible to pay the remaining balances directly to your existing lender(s).
In addition, by submitting this application, you authorize the loan originator to verify the accuracy and authenticity of all information supplied by you both internally and with the assistance of non-affiliated third parties. Specifically, you authorize the loan originator to verify your educational record, current education loan indebtedness, including payoff amounts and loan terms associated with any underlying loans you wish to refinance, with your previous educational institutions, underlying loan holders and/or servicers and other organizations and to verify your employment status by contacting your employer. The loan originator may also verify any income information that you provide. In all cases, the loan originator may disclose the fact that you are applying for credit from the loan originator and the Lender.
Military Lending Act Disclosures
If you are a member of the active military, or a spouse or dependent of a member of the active military, and your loan is subject to the provisions of the Military Lending Act ("MLA"), the following apply. (The federal government requires us to provide this notice to you. However, we do not assess any of the fees referenced in this notice):
Federal law provides important protections to members of the Armed Forces and their dependents relating to extensions of consumer credit. In general, the cost of consumer credit to a member of the Armed Forces and his or her dependent may not exceed an annual percentage rate of 36 percent. This rate must include, as applicable to the credit transaction or account: the costs associated with credit insurance premiums; fees for ancillary products sold in connection with the credit transaction; any application fee charged (other than certain application fees for specified credit transactions or accounts); and any participation fee charged (other than certain participation fees for a credit card account). Payments are a function of the amount you borrow and the applicable interest rate. Please refer to your Approval Disclosure for information regarding your monthly payments for this loan.

DISCLOSURE AND CONSENT TO USE ELECTRONIC SIGNATURES AND RECORDS
Please read this document carefully. Print a copy for your reference, or if you are using our device, we will print a copy at your request.
As used in this “Disclosure and Consent to Use Electronic Records” (the “Consent”) “Account” means the account you have created on this website to request a pre-qualification for a loan you obtain from us. “We,” “us,” and “our” means Splash Financial.
“You” and “your” means the person giving this consent.
“Online Service” means this Splash Financial website where you have created an Account.
“Records” means all documents related to an Account, such as your credit application, your customer agreements, consumer disclosures, privacy policies, and other documents, and all other communication or information related to the Account, including any records we are required by law to provide to you in writing during the term of our business relationship with you.
2. SCOPE OF CONSENT.
By giving your consent, you agree to conduct Account transactions with us either using your computer or mobile device to receive, view and electronically sign Records. You agree that such electronic signatures will consist of clicking on buttons and/or checking boxes where indicated. You also consent to the use of electronic Records displayed on the computer or device you are using, as well as any Records that we send to you electronically. We may provide Records to you electronically by emailing them to you at your email address, which may include the Records as attachments or as embedded links to a website that we operate and control. Your consent will be effective unless you withdraw it in the manner provided below. This consent applies only to communications with us and does not apply to any communications with a lender.
3. HOW TO UPDATE YOUR CONTACT INFORMATION.
You agree to provide us with your accurate personal contact information and to promptly notify us of any changes. If you have a working email address, your personal contact information must include that email address. You can update your contact information (including your email address) through the Online Service or by contacting us at 800-349-3938.
4. OBTAINING PAPER COPIES.
At any time and without charge, you may obtain free paper copies of your Records from us by through the Online Service or by contacting us at 800-349-3938 to request that a free paper copy be mailed to you. The request for a paper copy of a Record will not by itself constitute a withdrawal of your consent to receive Records electronically. We reserve the right, but are not required, to send a paper copy of any Record you authorize us to provide electronically.
5. WITHDRAWING CONSENT.
If you do not consent to the use of electronic signatures and Records, you will not be able to complete your transaction as your Account is available only online. In addition, if you give your consent, but withdraw it before completing your transaction, you will not be able to complete your transaction. After you have completed your transaction, you may at any time withdraw your consent to receive Records electronically through the Online Service or by contacting us at 800-349-3938 to update your profile information.
We will not impose any fee if you withdraw your consent to receive Records electronically. If you withdraw your consent to receive Records electronically, such withdrawal will not apply to Records that were furnished to you electronically before the date on which the withdrawal of your consent takes effect.
6. HARDWARE AND SOFTWARE REQUIREMENTS.
In order to use electronic signatures and Records you need to have an electronic device with internet access that supports the use of Microsoft Internet Explorer 7.0 or higher, Mozilla Firefox 3.5 or higher, Chrome, Safari 5.0 or higher, or an equivalent. You also need hardware as necessary to support this software, including, without limitation, an electronic device using a Windows 98, NT, 2000, ME XP, Vista or 7 operating system that supports 128-bit encryption, sufficient storage space to save copies of your Records, and a printer if you wish to print paper copies. You will need a program that can view, save and print PDF files (such as Adobe Reader 6.0 or higher). You will also need a working email account to receive, view, sign and print your Records. To verify that you have all of the necessary hardware and software for you to use electronic Records and signatures on your devices, please verify that you were able to read this electronic disclosure and that you also were able to print on paper or electronically save this page for your future reference and access or that you were able to e-mail this document to an address where you will be able to print on paper or save it for your future reference and access. If we ever change the hardware or software requirements in a way that creates a material risk that you will not be able to access or retain a Record that we previously sent you, we will send you notice of the revised requirements.
By checking the “Check My Rate” box, you agree that:
- You have read this consent,
- You will use electronic signatures and Records to complete your transaction,
- The electronic signatures and Records will have the same legal effect as written and signed paper documents,
- You have the necessary hardware and software to view, save and print copies of Records and to receive Records that we send to you by email, and
- Until or unless you notify us as described above to revoke your consent, you consent applies to every Record that we may send you related to your Account.

You understand and agree that the Lender and Lender’s agents (including the Loan Processor) may obtain a consumer credit report in connection with your loan application and in connection with any updates, renewals or extensions of any credit as a result of this loan application. If you ask, you will be informed whether or not such a report was obtained and, if so, the name and address of the agency that furnished the report. You also understand and agree that Lender or Lender’s agents may obtain a consumer credit report in connection with the review or collection of any loan made to you as a result of your loan application or for other legitimate purposes related to such loan
By providing us your telephone number, you agree that we may monitor and record telephone calls regarding your account to assure the quality of our service or for other reasons. You agree that we may call you, using an automatic telephone dialing system or otherwise, leave you a voice, prerecorded, or artificial voice message, or send you a text, e-mail, or other electronic message for any purpose related to the servicing and collection of your accounts with us (each a "Communication"). You agree that we may send a Communication to any telephone numbers, including cellular telephone numbers, or e-mail addresses you provided to us in connection with the origination of this agreement or at any time in the future. You acknowledge and confirm that you have the authority to provide the consent because you are either the subscriber of the telephone number(s) or you are the non-subscriber customary user who has authority to provide the consent. You also agree that we may include your personal information in a Communication. You agree that we will not charge you for a Communication, but your service provider may. In addition, you understand and agree that we may always communicate with you in any manner permissible by law that does not require your prior consent.
TCPA OPT IN
While the Pre-Qualification and application request are pending, by checking the box, I authorize Splash Financial to deliver calls and text messages to the telephone number(s) that I have provided above. I understand I am not required to give this authorization as a condition of requesting a Pre-Qualification or receiving an Offer. I am either the subscriber of these telephone numbers or a customary user with the authority to give consent for these communications.
